Disclosure: Subscriber agrees that the Company may disclose any and all subscriber information including assigned IP numbers, account history, account use, etc. to any law enforcement agent who makes a written request without further consent or notification to the Subscriber
Content: All services provided by ReadyWire Multimedia Solutions may be used for lawful purposes only. Transmission, storage, or presentation of any information, data or material in violation of any United States Federal, State or City law is prohibited. This includes, but is not limited to: copyrighted material, material we judge to be threatening or obscene, unlicensed software or files, or material protected by trade secret and other statue. The subscriber agrees to indemnify and hold harmless ReadyWire Multimedia Solutions from any claims resulting from the use of the service which damages the subscriber or any other party.

- Pirated software
- "Illegal MP3's" - Consists of copyrighted audio
- Hackers programs or archives
- Warez Sites
- Child Pornography
ReadyWire Multimedia Solutions will be the sole arbiter as to what constitutes a violation of this provision.
Server Abuse: Any attempts to undermine or cause harm to a ReadyWire server or customer of ReadyWire Multimedia Solutions is strictly prohibited. ReadyWire Multimedia Solutions will pursue legal action to the fullest extent for all abuse of the ReadyWire network.
Technical Support: ReadyWire Multimedia Solutions provides 24 x 7 technical support to our subscribers (except for few holidays and short company meetings when we close our center.) We limit our technical support to our area of expertise. The following is our guidelines when providing support: ReadyWire Multimedia Solutions provides support related to your virtual site physical functioning. ReadyWire Multimedia Solutions does not offer tech support for application specific issues such as cgi programming, html or any other such issue. At this time, ReadyWire Multimedia Solutions does not offer technical support via phone.
Payment: Subscriber acknowledges that the nature of the service furnished and the initial rates and charges have been communicated to Subscriber. Subscriber is aware that ReadyWire Multimedia Solutions may prospectively change the specified rates and charges from time to time. Accepted methods of payment include Visa, Mastercard, Discover Card, American Express, PayPal, & Checks.
PayPal payments must be sent to billing@readywire.com. Wire Transfers may be available for customers who would like to pay on a semi-annual or annual basis.
ReadyWire reserves the right to deny Client the use of any payment method for, but not limited to, abuse or misuse of a payment method. Abuse of a payment method may also be grounds for further disciplinary action up to and including the immediate and permanent cancellation of the Client's services or their entire account with The Company. If a check or ACH draft is returned for any reason, the account will be assessed a $30 service charge per item. If payment for the returned check amount and service fee is not remitted in full by 2 P.M. CST the following business day, the server will be deactivated until payment is received and will be subject to regular reconnect fees.
The promotional offer is contingent upon ReadyWire achieving and maintaining its cost of service goals including but not limited to rates charged to company by its suppliers.
Establishment of this service is dependent upon receipt by ReadyWire Multimedia Solutions of payment of stated charges. Subscriber agrees that ReadyWire Multimedia Solutions automatically charges subscriber`s credit card every month. ReadyWire Multimedia Solutions reserves the right to process client credit cards from 7 to 14 days before the actual due date to ensure that the funds are received by the due date. Credit cards that are declined for any reason are subject to a $1.00 declination fee. Service may be interrupted on accounts that are past due. Service interrupted for nonpayment is subject to a $50 reconnect charge. Accounts not paid by due date are subject to a $25 late fee. Accounts that are not collectable by ReadyWire Multimedia Solutions may be turned over to an outside collection agency for collection.
If your account is turned over for collection, you agree to pay ReadyWire Multimedia Solutions a "Processing and Collection" Fee of not less than $50 nor more than $150. If you desire to cancel your account, please follow the proper procedure to do this as outlined in this TOS. Co-location servers that are terminated for non payment will be considered abandoned and forfeited after 30 days. All payments to ReadyWire Multimedia Solutions are nonrefundable. This includes the one time setup fee and subsequent charges regardless of usage. All overcharges or billing disputes must be reported within 30 days of the time the dispute occurred. If you dispute a charge to your credit card issuer that, in ReadyWire Multimedia Solution's sole discretion is a valid charge under the provisions of the TOS and /or AUP, you agree to pay ReadyWire Multimedia Solutions an "Administrative Fee" of not less than $50 and not more than $150.
Suspension/Deactivation: If any terms or conditions are failed to be followed it will result in grounds for account suspension or de-activation. ReadyWire Multimedia Solutions reserves the right to remove any account without prior notice. If ReadyWire Multimedia Solutions deactivates your account(s) for violating policy, your will forfeit your rights to a refund -- and none will be given. No refunds for advance payments, on deactivated accounts. Normal policy is a warning first, and account de-activation the second offense. Serious offenses may cause immediate de-activation. ReadyWire Multimedia Solutions will be the sole arbiter as to what constitutes a violation of this provision.
Cancellation Policy: Client must submit service cancellations by opening a ticket through our client portal at least 7 days but not more than 30 days before the end of the service's billing cycle. Cancellation requests are not accepted through phone, email, fax, or any other method besides through opening a ticket through our client portal. You must have all account information to cancel an account. Only the authorized account holder may cancel the account.
In the event of cancellation, customer will automatically be billed for any excess bandwidth usage during the then-current monthly billing cycle.
Excessive Bandwidth Use: Client agrees that bandwidth usage shall not exceed the number of gigabytes per month for the services ordered by Client. ReadyWire will monitor Client's bandwidth usage and will provide RTG graphs of bandwidth usage for Client to review in the ReadyWire client portal. ReadyWire shall have the right to take corrective action if Client's bandwidth usage exceeds the amount allocated by Client's service plan ("Allocation"). Such corrective action may include the assessment of additional charges, disconnection or discontinuance of any and all services, or termination of this agreement, which actions may be taken is in ReadyWire's sole and absolute discretion. ReadyWire believes in communicating with our clients and will try to work with our clients to resolve any overage issues before taking action which could cause a client's service to become unavailable.
Bandwidth usage is measured on a monthly basis coinciding with Client's billing cycle. Both incoming and outgoing traffic are counted. In the event that a customer exceeds the included allocation, ReadyWire may, at its sole discretion, collect a deposit in the amount of $0.75 per GB for the projected overage for the month, immediately against customer's credit card on file with ReadyWire.
Client agrees to pay ReadyWire any additional fees for bandwidth overages within 3 days of the invoicing period at a rate of $0.75 per GB of bandwidth used over the Allocation. Any bandwidth overage bill not paid within three (3) days of invoicing will subject the server and services to suspension.
Unused bandwidth allocations cannot be carried over to future months, or applied to other servers.
Account Termination: Violation of our anti-spam policy will be grounds for immediate account termination. Web sites deemed offensive, pornographic or racially degrading, by ReadyWire, will be removed from our servers without notice. Web sites promoting, making available or otherwise contributing to software piracy, hacking, spamming, denial of service attacks and/or damage to commercial networks or servers will be removed from our servers without notice and illegal acts will be reported and prosecuted. Abusive behavior of any type will not be tolerated.
Accounts using up enough server resources, to slow or crash a server, will be shut down without notice. If an account is shut down, due to server resource issues, we will (upon request) make a reasonable effort to help get the account unsuspended. This includes tracking down the offending program, if applicable, and/or making available other arrangements for hosting the account on a semiprivate or private server (additional fees may be required).
Server Activity: All server activity is logged. Any snooping, hacking, or other inappropriate activity of any type outside of your account, on our servers, will be grounds for termination. In addition, your account is for web and email use only, any other activities, at our sole discretion, will be grounds for termination as well.
Courtesy Transfer Service: ReadyWire performs all account transfers, account moves, cPanel transfers, server transfers and any other service which involves ReadyWire copying files of yours from a third party service to your ReadyWire service, hereafter known as a "transfer" as a courtesy service only. By requesting ReadyWire to perform a transfer you agree indemnify and hold harmless ReadyWire from any and all liability arising from the transfer and/or copying of your accounts. You also agree ReadyWire is not responsible for any issues relating to the transfer of your accounts, both on your ReadyWire service and at any other third party service from which ReadyWire may be transferring your accounts from, including but not limited to, missing or corrupted files, improperly transferred accounts, any and all fees you may incur from third party services such as bandwidth fees or charges from delays in transferring account, settings or files from third party providers which may not transferred, any downtime or outages, DNS problems, accounts set up on incorrect IP addresses, any issues at third party services which delay or prevent ReadyWire from performing the service, or any other issues. ReadyWire makes no guarantees regarding the availability of our transfer service or the amount of time it takes to perform transfers.
Domain Name Registration and Renewal Policy: ReadyWire Multimedia Solutions will make every effort to register and/or renew your requested domain name. This is not a guarantee that your requested domain name is available for registration and/or renewal. Your domain name may go unregistered and/or renewed, due to circumstances beyond our control, and will not be grounds for compensation of financial loss. An order for domain name registration and/or renewal, does not guarantee domain name registration and/or renewal. Domain names will not be registered and/or renewed until payment is received. If requested domain name is not registered and/or renewed by ReadyWire Multimedia Solutions, the domain registration fee will be refunded.
Domain registration fees are not refundable. If we register a domain name, on your behalf, as part of a free registration promotion - cancellation or termination of your account will void the promotion offer and you will be charged $20 for your domain name registration.
All domain names, registered by ReadyWire Multimedia Solutions, are done so in the name of the customer placing the order.
Changes to the Terms of Service This Terms of Service may be amended, at any time, at the discretion of ReadyWire Multimedia Solutions. All accounts are required to comply with any changes made to these policies.
Such changes, modifications, additions or deletions shall be effective immediately upon posting on-line at this location. You acknowledge and agree that it is your responsibility to review this site and this TOS periodically and to be aware of any modifications. Your continued use of the services after such modifications will constitute your: (a) acknowledgment of the modified TOS; and (b) agreement to abide and be bound by the modified TOS. If you do not agree to these terms, please contact us to cancel your services.
If you are unsure if what you are doing is against our TOS, please contact us. There are no refunds granted for accounts terminated due to TOS violation.
Misc
- We reserve the right to refuse service to anyone at any time for any reason.
- The Company is not responsible for data integrity on equipment reclaimed for non-payment.
- Illinois residents agree to pay all taxes applicable to your account.
- Anything not explicitly stated in this TOS is subject to interpretation at ReadyWire's sole and absolute discretion.
- You, as ReadyWire's client, are solely responsible for the content stored on and served by your ReadyWire service.
